BODY FOCUSED LLC

These Terms and Conditions govern the purchase and sale of products through the Body Focused website. Please read them carefully before placing an order. By accessing our website or purchasing from us, you agree to be bound by these Terms.

We reserve the right to update or modify these Terms at any time. The Terms in effect at the time your order is placed will apply to that transaction.

2.2 Acceptance

Your order is accepted only once we send you a shipment confirmation email. At that point, a binding contract is formed between you and Body Focused LLC.

2.3 Eligibility

You must be at least 18 years old and authorized to use the payment method provided. If you are under 18, a parent or legal guardian must complete the purchase.

3. RIGHT TO REFUSE OR CANCEL ORDERS

We reserve the right to refuse, limit, or cancel orders at our discretion, including but not limited to cases involving:

  • Product availability issues
  • Errors in pricing or product descriptions
  • Inability to verify payment information
  • Suspected fraud or unauthorized activity
  • Orders that appear intended for resale or commercial use

If an order is canceled, any amounts charged will be refunded to the original payment method.

4. PRODUCTS & AVAILABILITY

4.1 Product information

We offer apparel, accessories, and digital gift cards. All product descriptions, images, and specifications are provided for informational purposes only. While we strive for accuracy, minor variations in color, fit, or appearance may occur.

4.2 Availability

All products are subject to availability. We do not guarantee that any item will be available at all times.

4.3 Gift cards

Gift cards are issued digitally and are subject to the following:

  • Gift cards cannot be purchased using other gift cards
  • Gift cards do not expire
  • Gift cards are non-refundable and non-transferable
  • Gift cards cannot be exchanged for cash
  • Gift cards may only be redeemed on our website

5. SHIPPING & DELIVERY

5.1 Shipping territory

We currently ship within the United States only.

5.2 Delivery timing

Estimated delivery times are provided for convenience and are not guaranteed. Delays may occur due to factors beyond our control.

5.3 Risk of loss

Risk of loss and title for products pass to you upon delivery of the products to the carrier.

5.4 Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to weather conditions, carrier disruptions, labor disputes, or governmental actions.

6. RETURNS & REFUNDS

6.1 Return eligibility

We accept return requests within 14 days of delivery, subject to the conditions below.

Returned items must be:

  • Unworn and unwashed
  • In original condition
  • With original tags attached
  • Returned in original packaging when possible

We reserve the right to refuse returns that do not meet these conditions.

6.2 Return shipping

Customers are responsible for all return shipping costs unless otherwise stated.

6.3 Non-returnable items

The following items are final sale and are not eligible for return, refund, or exchange:

  • Final sale items
  • Underwear
  • Bottles
  • Socks
  • White or light-colored apparel
  • Gift cards

These exclusions are in place for hygiene, safety, and quality control reasons.

6.4 Refunds

Approved refunds will be issued to the original payment method after the returned item has been received and inspected. Original shipping charges are non-refundable.

We reserve the right to refuse returns that do not comply with this policy.

7. PRICING, TAXES & PAYMENT

7.1 Pricing

All prices are listed in US dollars. Applicable sales tax is calculated at checkout based on the shipping address.

7.2 Payment processing

We accept payment methods made available at checkout. Payment authorization may occur at the time of order placement, and charges are completed upon shipment.

7.3 Pricing errors

If a pricing error is identified, we reserve the right to cancel the affected order and issue a refund.

8. PROMOTIONS & DISCOUNT CODES

Discount codes:

  • Are valid for a limited time only
  • Cannot be combined with other promotions
  • Do not apply to gift cards
  • Apply only to eligible items

We reserve the right to modify or withdraw promotions at any time.

9. DISCLAIMERS & WARRANTIES

To the fullest extent permitted by law, all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Body Focused LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability arising from any claim related to a product or order shall not exceed the amount paid for the product giving rise to the claim

Nothing in these Terms limits liability where such limitation is prohibited by law.

11. PERSONAL USE ONLY

Products are sold for personal use only. We are not responsible for losses arising from commercial, resale, or business use of our products.

12. PRIVACY

Your personal information is collected and processed in accordance with our Privacy Policy, available on our website.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.

14. ARBITRATION & CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to your purchase, use of the website, or these Terms shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its applicable rules.

Arbitration will be conducted on an individual basis. You waive the right to a jury trial and to participate in any class or representative action.

Opt-out

You may opt out of this arbitration provision within 30 days of your first purchase by emailing support@shopbodyfocused.com with your name, email address, and a clear request to opt out.

If you opt out, disputes will be resolved exclusively in the state or federal courts located in Maryland.

15. GENERAL PROVISIONS

  • These Terms constitute the entire agreement between you and Body Focused LLC
  • If any provision is found unenforceable, the remaining provisions will remain in effect
  • Failure to enforce any right does not waive that right
  • We may assign our rights and obligations under these Terms without restriction
